These Terms of Service apply to (a) your use of the website at saspherton.co.uk, and (b) any reservation, Klub membership, gift voucher, or service contract you enter into with Saspherton & Hertford Ltd.
3.1 Definitions
In these Terms:
- "we", "us", "our" means Saspherton & Hertford Ltd, the salon's operator.
- "you", "your" means the individual who is reserving a table, joining the Klub, purchasing a gift voucher, or using the website.
- "the salon" means the physical premises at 22 Chiltern Street, Marylebone, London W1U 7QB.
- "the website" means saspherton.co.uk.
- "Klub" means the Saspherton Klub annual-membership programme.
- "Klub Rules" means the rules governing the Klub, set out at /klub-rules/.
- "table fee" means the per-guest charge applied to participation at the four cyclical Klub-evening formats.
3.2 Acceptance
By using the website you agree to these Terms. By making a reservation you agree to the reservation-specific provisions in Sections 3.5–3.7. By joining the Klub you agree, in addition to these Terms, to the Klub Rules.
3.3 Eighteen-plus
The salon is an eighteen-plus venue. Children under eighteen are not seated. Acceptance of an age-gate confirmation on the website confirms that you are eighteen or over. We may request photographic identification at the door if there is reasonable doubt.
3.4 The website
The website is offered free of charge for general information about the salon. We may modify or withdraw the website, or any part of it, without notice. We make no warranty that the website will be error-free or available without interruption.
3.5 Reservations
To reserve a table you must complete the reservation form at /reservations/ or telephone +44 20 7935 4220 during opening hours. We will respond by email within one working day to confirm, decline, or request further information. A confirmed reservation forms a contract between you and the salon.
Klub members may reserve up to six weeks ahead. Non-members may reserve up to two weeks ahead.
A confirmed reservation is for the time and party-size confirmed. The salon will hold your table for fifteen minutes after the booked time; if you have not arrived within fifteen minutes and have not telephoned, we may release the table.
For tables of six or more guests, we may request a £25-per-cover deposit at the time of booking; the deposit is fully redeemable against the bill at the salon.
3.6 Cancellation
A reservation may be cancelled or amended without charge up to 24 hours before the booked time. Same-day cancellations of tables of six or more incur a £25 per cover charge, debited against the deposit (where one was taken) or invoiced subsequently.
Klub-evening reservations follow a separate cancellation schedule, set out at the time of booking and reproduced on the confirmation email.
3.7 Refusal of service
The salon may refuse service to any person whose conduct is, in the reasonable opinion of the manager on duty, inconsistent with the salon's atmosphere, with the comfort of other guests, or with applicable law. Reasons for refusal include (without limitation): intoxication; abusive behaviour; failure to confirm age; violation of the dress code described at /reservations/; previous violations of the Klub Rules.
3.8 Prices and payment
Menu prices are stated in pounds sterling and are inclusive of VAT at the prevailing rate. A discretionary 12.5% service charge is added to all bills. Card payments are accepted (Visa, Mastercard, American Express); cash is also accepted at reception. We do not accept cheques.
For Klub-evening table fees and Klub annual subscription, payment terms are described at the time of booking and on the confirmation email.
3.9 Gift vouchers
Gift vouchers are sold in denominations of £50, £100, £250, £500. They are issued on cream card-stock and posted by Royal Mail signed-for, or collected at reception. They expire eighteen months from the date of purchase. They are not redeemable for cash and they cannot be replaced if lost.
3.10 Saspherton Klub
The Klub is a private members' programme. The annual subscription is £1,800 per member. Membership is for one calendar year (1 January to 31 December), pro-rated for new members joining mid-year. Klub Rules at /klub-rules/ apply to all members.
The salon may decline a Klub application without giving a reason. The salon may suspend or terminate a Klub membership for a serious or repeated breach of the Klub Rules; in such a case, the unexpired portion of the annual subscription is not refunded.
3.11 Klub-evening compliance framework
The four cyclical Klub-evening formats are members' social card play. Table fees cover hospitality. Prizes are exclusively in kind. The Klub-evening format does not constitute gaming licensable under the Gambling Act 2005. The full disclaimer is at /legal/ Section 1.5.
3.12 Liability
Nothing in these Terms limits or excludes our liability for death or personal injury arising from our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
Subject to the foregoing, our total liability to you, in contract or in tort (including for negligence), for any loss or damage arising from a single event or a series of related events, is limited to the greater of (i) £1,000 and (ii) the total amount you have paid to the salon in the twelve months preceding the event. We do not accept liability for indirect or consequential losses, for loss of profit, for loss of goodwill, or for loss of opportunity.
3.13 Loss of items at the salon
The salon is not a deposit institution. We will accept your coat at reception and hang it; however, we are not liable for loss or damage to coats, hats, scarves, bags, umbrellas, or other items left with us, except where the loss arises from our negligence. We strongly recommend that you do not leave items of significant value at reception.
3.14 Photography in the salon
The salon does not permit photography or videography by guests inside the salon, in respect of other guests, or of the card-room tables. The salon does take its own photography on rare occasion (commissioned interior shots, no other guests visible); these images are used in our own marketing materials only.
3.15 Complaints
If you have a complaint, please address it in the first instance to the Klub Coordinator (klub@saspherton.co.uk) for Klub-related matters, to the General Manager (office@saspherton.co.uk) for non-Klub matters, or to the duty manager at the salon at the time of your visit. We aim to respond substantively within five working days.
If your complaint is not resolved to your satisfaction, you may refer the matter to Westminster City Council Trading Standards for service-quality matters, or to the Information Commissioner's Office for data-protection matters.
3.16 Force majeure
The salon is not liable for any failure of performance arising from a cause beyond our reasonable control, including (without limitation) acts of God, severe weather, fire, flood, public-health emergency, public-utility outage, transport disruption, government order, or industrial action. In the event of a temporary closure, confirmed reservations and Klub-evening bookings will be rescheduled or refunded at the member's election.
3.17 Variation
We may amend these Terms from time to time. Material changes will be announced on the website. The version in force at the time of your reservation is the version that applies to that reservation; the version in force at the start of a Klub year is the version that applies to that year's membership.
3.18 Severability
If any provision of these Terms is held to be unenforceable in whole or in part, that provision will be severed and the remainder of the Terms will continue in full force.
3.19 Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
